More than 82,000 people due to leave Germany have been offered a new option to stay, through the option Residence Act
The statute will remain in effect until the end of this year, but new rules will be implemented by the German CDU/CSU alliance
The Opportunity Residence Act is in effect for three years and went into effect in late December 2022. All individuals who have lived in this nation for at least five years as of the deadline of October 31, 2022, with a temporary authorization, resident permit, or tolerated stay are covered by the Act.
They and their family members may also be granted an 18-month probationary residency visa.
Those who must leave Germany but cannot be deported for certain reasons, such as not having the necessary paperwork or being unwell, are known as tolerated individuals. The ZDF Heute study emphasizes that the tolerated status is always transient.
Those who can sustain themselves financially, speak German well enough, and have no criminal history may be given permanent residence when the 18-month probationary residence permit expires.
However, criminals and people who have made repeated, deliberate fabrications about who they are cannot be given the option to stay.
According to data from the German Interior Ministry, 5,970 individuals who were given a residency permit had previously been on a toleration permit because their identities were unclear
The Opportunity Residence Act ought to be repealed
The option to apply under the option Residence Act will cease by the end of this year. But, the Member of the German Bundestag, Sebastian Münzenmaier, indicated that action should be made in order to terminate this act,
He objected to the possibility of allowing individuals to remain in Germany who postponed their deportation by giving inaccurate or insufficient information about their background and identification
According to the coalition agreement between Germany’s CDU, CSU, and SPD, by December 2024, tolerated foreigners who are well-integrated, have a distinct identity, have worked for a year to support themselves, and have been in the country for at least four years should also be granted a temporary residence permit.
